These Terms of Service (“Terms”) govern your access to and use of the website delano.miami, the AI concierge (“Sofia”), and any related communications, forms, or services (collectively, the “Service”) provided by Andres Cadavid, a licensed Florida real estate broker (“we,” “us,” or “our”). By accessing the Service or submitting your information, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use this Service.

2. Real Estate Information Disclaimer

All property information, pricing, availability, floor plans, renderings, amenities, completion dates, and similar details displayed on the Service or shared by the AI concierge are provided for informational purposes only. They are sourced from developers, multiple listing services, and other third parties and are subject to change without notice. We make no representation or warranty as to the accuracy or completeness of this information.

Pricing, incentives, availability, taxes, fees, HOA dues, and developer terms can change at any time. Prospective buyers should independently verify all information directly with the developer or seller and consult their own attorney, accountant, and tax advisor before making any purchase decision.

Nothing on the Service constitutes legal, financial, tax, or investment advice. Renderings and virtual tours are artist conceptions and may differ from the as-built product.

3. Brokerage Relationship

Andres Cadavid is a licensed Florida real estate broker. The Service is intended to help prospective buyers, investors, and tenants explore properties in Miami and South Florida. Use of the Service does not, by itself, create a broker-client relationship. A broker-client relationship is established only by a written agreement signed by both parties.

4. Communications and SMS Consent

By providing your contact information and consenting through any opt-in checkbox on the Service, you authorize us to contact you by phone, email, SMS, and chat regarding your real estate inquiry. Message and data rates may apply for SMS. You can opt out of SMS at any time by replying STOP, or unsubscribe from emails using the link in any message. 5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Attempt to disrupt, reverse-engineer, scrape, or interfere with the Service or the AI concierge
  • Use the Service to harass or spam us, our staff, or any third party
  • Impersonate another person

6. AI Concierge (“Sofia”)

Sofia is an AI-powered assistant designed to help you explore Miami real estate. Sofia’s responses are generated by software and, while we work to keep them accurate, may contain errors, omissions, or outdated information. Always confirm important details (pricing, availability, contract terms, dates) directly with us before relying on them.

7. Intellectual Property

All content on the Service, including text, graphics, logos, photos, videos, renderings, software, and the AI concierge, is owned by us or our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission, except for personal, non-commercial use related to evaluating a property.

8. Third-Party Content and Links

The Service may include links to third-party websites, developer sites, or content. We do not control and are not responsible for the content, privacy practices, or accuracy of any third-party site.

9. Disclaimer of Warranties

The Service is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any direct damages will not exceed one hundred U.S. dollars (US$100).

11. Indemnification

You agree to indemnify and hold harmless Andres Cadavid from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

13. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top reflects the most recent version. Your continued use of the Service after a change indicates your acceptance of the updated Terms.
